Types of Separate Property in Texas Divorce Proceedings

When you’re going through a divorce proceeding in Dallas, your divorce attorney is the person who will help you determine which assets and debts are separate property during a divorce and which are not. Your attorney will also represent your interests if there is any ambiguity. Generally, however, the state of Texas recognizes three different types of separate property.

The first type of separate property is that which was owned by a spouse before getting married. This can include trivial items, such as an old sweater, or more substantially valuable items, such as a car. The latter situation is one where things can get murky, especially if the title and registration were changed during the marriage, and situations such as these are often where conflict enters the picture. The second type of separate property includes items that were received by a spouse as a gift or inheritance, and the third are specific types of personal injury recoveries.

The crux of the matter lies in proving which conditions apply should one make the claim that any asset is separate property. In some instances, this can be a simple task, such as showing the title to a property that belonged to a spouse previous to marriage. More complex cases, however, could include a checking account that was owned by a spouse at the time of marriage, but which has been used by both spouses through the duration of the marriage and includes the mingling of community property through numerous transactions. A Dallas divorce attorney will represent your interests in cases of conflict that arise over complex separate property issues.
