Medical Malpractice in Dallas

Patients entrust their lives to medical professionals, counting on them to do their job carefully and thoroughly. Unfortunately, medical mistakes are quite common. According to Dr. John T. James’ study, “A New, Evidence-based Estimate of Patient Harms Associated with Hospital Care” in Journal of Patient Safety, more than 400,000 patients die each year as a result of preventable harm.

If you or your loved one suffered harm because of a medical mistake, we encourage you to call and discuss your situation to determine if you qualify to file a medical malpractice claim or lawsuit. You can reach Warren & Migliaccio in Dallas at 888-584-9614 and schedule a free consultation.

What is medical malpractice?

It’s important to make a distinction between what malpractice is and what it is not. Not all mistakes that a doctor, hospital, clinic or another provider makes is legally considered malpractice. For the mistake to be considered malpractice, the provider must have failed to render care that meets acceptable industry standards. In other words, the doctor must have acted or failed to act in a way that other doctors in the same situation would have acted – and the doctor’s negligence caused the patient harm.

Below are few examples of potentially viable medical malpractice cases.

  • Wrong diagnosis, delayed diagnosis or missed diagnosis
  • Birth mistakes such as forceps misuse, delayed cesarean section, failure to recognize a medical condition from which the mother suffered, etc.
  • Surgical mistakes such as operating on the wrong patient or wrong body part
  • Anesthesia mistakes
  • Prescription errors, such as wrong medication, wrong dosage and prescribing contraindicated drugs
  • Failing to explain the risks of a procedure or treatment with the patient
  • Failing to treat the patient adequately after a diagnosis

Our malpractice attorneys in Dallas can answer your questions.

If you qualify to file a medical malpractice claim or lawsuit, you might be able to recover your damages and obtain a sizable settlement. You will need to take action as soon as possible because there is a strict time limit on when you are allowed to file your claim.
