Guide to “Birds Nest” Custody after Texas Divorce

March 29, 2012

For many couples who have reached an impasse in their marriage and are considering divorce, minimizing the impact of divorce on the children is a priority. An attorney from our team of Texas divorce lawyers can answer your questions about how divorce and child family law will apply to your case.

Divorce can be a very difficult experience for a child and may cause insecurity or resentment, so parents would be wise to take extra precaution by doing everything in their power to control the impact.

One method that exes have been implementing to offset the impact of a divorce on children is to employ “birds nest custody.” This divorce method switches the standard joint custody dynamic by rotating between the parents at 1 home rather than the children between 2 different homes.

Birds Nest Custody in Your Divorce

Birds nest custody involves the children living in one place, usually the family home prior to the divorce. The parents rotate through the children’s home on a consistent schedule, splitting the weeks and minimizing the disruption for the children.

This completely changes the dynamic of joint custody – instead of the children being shuffled back and forth from house to house, the parents move back and forth to spend individual time with their children in an environment that is consistent.

The benefits to birds nest child custody are that the children stay in one fixed location, minimizing the disruption in their school and neighborhood activities.

However, this arrangement can sometimes be difficult for the parents, who would each need to have a separate residence to return to when their rotation with the children ended. Additionally, the cost of doing so may be prohibitive for some families. It may also be further complicated when one or both of the parents begin to date.

Birds nest custody can negate some of the impact your divorce has on your children, but that doesn’t necessarily mean that it is the only way to do so, or that it is the right way for you and your family. There are other means that you can pursue to provide stability for your child, both physically and emotionally.

Compromising with Your Ex-Spouse for the Benefit of Your Child

Arguments between ex-spouses happen, but they can be even more detrimental when children witness them. Remember to avoid heated arguments in front of your children. If you’re having an angry discussion with your ex, drop the conversation or put it aside for later so that your children don’t internalize bad fighting styles.

Don’t badmouth your ex in front of your children; remember, your child still loves both of you and shouldn’t be made to choose. Your child wants a relationship with both parents, and even though you and your ex may no longer be spouses, you are still partners in raising your child together.

The extra effort it takes to minimize the effects of your divorce on your children can be difficult for both you and your ex-spouse. Even the most amiable divorces will still experience problems. Remember that you do not have to go through this process alone, and that there are provisions and support networks available to divorced spouses who still want both parents to have a relationship with the children.

You can reach out to family mediators or your church group. Finding a neutral third party and resources from social services may help the healing process. If you’re considering divorce and want to minimize the impact that your divorce has on your children, speak with an attorney from our hardworking and passionate team of divorce lawyers in Texas.
