Texas Family Court Rules under Divorce Law for Child Support

Post by Christopher Migliaccio

A TX divorce lawyer can help you navigate through what can be confusing family court rules when it comes to divorce law and child support. This is your best way to ensure that your case is treated fairly and the best interests of you and your children are taken into account.

Divorce law, child support and other complicated matters don’t have to overwhelm you. Seeking legal counsel can help you understand what options are available and what you can do to better protect your rights. You also will likely stand a better chance at being satisfied with the outcome if you have legal help on your side.

Family Law in Texas Regarding Child Support

Parents who wish to obtain or provide support of various means to their children can do so through the Child Support Division, a service provided by the Office of the Attorney General (OAG) inTexas. This service is provided free of charge.

There are a variety of services and support that may be found necessary for your child which may include:

  • establishment of paternity;
  • locating an absent parent;
  • reviewing and adjusting payments for child support;
  • collecting and distributing payments for child support; and
  • establishing and enforcing orders for medical and/or child support.

Family law in Texas isn’t always black and white. Therefore, it may be necessary to enlist the help of a TX divorce lawyer. A lawyer can help you fight for the services and support that are appropriate and necessary for your child.

Family Court Rules Regarding Child Support and Rights of a Parent

Understanding a parent’s rights when it comes to the Child Support Division is important. Parents have the right to submit an inquiry or complaint regarding their case.

Parents also have the right to professional, timely customer service and that their information will be kept confidential. This includes the address of where they reside. When these rights have been violated, a lawyer can help.

Family Court Rules for Child Support and Responsibilities of a Parent

Just as there are rights, there are also responsibilities that parents must fulfill. One of them is to provide financial support for their child. The responsibility to feed, clothe and house a child falls on the parent who has primary custody. However, at any time the child is in the other parent’s custody, that parent has the same responsibilities.

The parent with primary custody is also responsible for financial needs that go beyond the basic necessities, such as paying for school books or extracurricular activities. These are generally not required of the parent who doesn’t have primary custody of the child.

Health insurance is usually provided by the parent who doesn’t have primary custody, in most cases this will be the father. However when it comes to uninsured healthcare expenses, both parents must pay half.

Other responsibilities of a parent include:

  • appearing in court;
  • completing any documents pertaining to the case; and
  • notifying the OAG if there are any changes to their phone number or address.
