What to Do if Credit Corp Solutions Sues You in Texas

Post by Christopher Migliaccio

Have you received a notice that a company called Credit Corp Solutions Inc. is suing you over unpaid debt? Do not brush it off like it is a scam. Below, our North Texas debt defense lawyers discuss what you need to know about Credit Corp Solutions Inc. and why they sue consumers. We also discuss what you can do if facing a Credit Corp Solutions lawsuit in Texas.

Is Credit Corp Solutions a Real Company?

Credit Corp Solutions is a legitimate company located in Sandy, Utah. It also goes by other trading names in states outside Texas, including Tasman Credit Corp, Tasman Credit, and Credit Corp Collections Agency Inc.

What Is Credit Corp Solutions Inc?

Credit Corp Solutions is a debt buyer and collection company. According to its website, Credit Corp purchases and collects consumer debt from financial service providers. Debt buyers like Credit Corp purchase charged-off debt from creditors for a fraction of the amount owed. Then, Credit Corp works to collect the total amount of debt owed to make a profit.

Why Is Credit Corp Solutions Suing Me?

If a creditor has tried to collect from a debtor without success, eventually, it may charge off the debt. Charging off debt means the creditor does not expect to get paid back and has written the account off as a loss. To make some of its money back, the creditor may sell the borrower’s debt to a debt buyer like Credit Corp for pennies on the dollar. When this occurs, Credit Corp owns the debt, and the debtor owes Credit Corp, not the original creditor.

If Credit Corp is suing you, it likely means it purchased a delinquent account from your original creditor. It is common for debt buyers to use litigation to recover the debt it claims is owed. The law firm Scott & Associates, P.C. handles many Texas debt collection cases for Credit Corp.

What to Know About a Credit Corp Solutions Lawsuit

Our attorneys understand how scary and stressful it is to get sued, especially by a debt collection company you may have never heard of before. If you are in this situation, you have legal options. We recommend working with an experienced debt defense lawyer who can help you understand your best legal options.

The most important thing you can do is not ignore the lawsuit. You may have viable legal defenses against Credit Corp’s claim, or you may be able to reach a favorable settlement. Depending on your situation, your attorney may be able to help you discharge your debt through bankruptcy.

Credit Corp Solutions lawsuits are not scams, and you can count on Credit Corp to have attorneys on its side fighting to collect from you. We recommend having a debt defense lawyer on your side to defend your rights and fight for your best interests. Ignoring the lawsuit can only worsen your problem and may result in Credit Corp winning the lawsuit by default. If this occurs, Credit Corp may obtain a default judgment against you.

You want to avoid a default judgment. A default judgment would legally entitle Credit Corp to the total debt amount it claims you owe. Depending on the type of debt you owe, Credit Corp may be able to collect from you in various ways. The judge could grant garnishments against your bank accounts or paycheck to pay off your debt. Additionally, the judge could allow a property lien or claim against your property or authorize property seizure of your assets and personal property to pay off your debt.

How to Avoid a Default Judgment in Texas

Responding to the lawsuit and showing up in court will help you avoid a default judgment. Depending on the court handling the case, you may only have 14 days to provide a written response to the lawsuit. Your response should address the allegations against you and give any defenses you may have to the lawsuit. We also recommend demanding proof of the debt because the burden of proof is on Credit Corp Solutions. An experienced debt defense attorney can prepare and file your response on your behalf and ensure you adhere to critical deadlines.

What Are My Legal Options if Credit Corp Solutions Inc. Is Suing Me?

Your best legal options depend on your unique situation. However, your options may include:

  • Negotiating a settlement. If you recognize that you owe the debt, you may be able to negotiate a settlement with Credit Corp outside of court. Our experienced debt defense lawyers can help you negotiate a favorable settlement that is less than the original amount of debt.
  • Fighting the lawsuit. There may be many reasons to fight a debt collection case. For example, Credit Corp may not have enough evidence to prove you owe the debt. In other cases, the amount of debt may be incorrect, or you may not own the debt. It is also possible that the statute of limitations has passed.
  • Exploring alternative legal options. You may have alternative legal strategies available to you to deal with the debt. Our North Texas debt defense lawyers help our clients determine alternative debt resolution options such as bankruptcy.
