Is Chapter 7 bankruptcy harder to qualify for now?

Our law firm in Dallas has spent years making sure we fully understand how the 2005 changes to U.S. bankruptcy rules will impact our clients. The bankruptcy cases we’ve handled since have shown that these new laws can make it more difficult for you to file Chapter 7 bankruptcy in Dallas, as well as the rest of the country.

The old U.S. bankruptcy rules allowed a bankruptcy judge to dismiss Chapter 7 bankruptcy cases when the debtor was eligible to file Chapter 13 instead. The new rules created more criteria for determining if a debtor met the criteria to fund a Chapter 13 repayment plan.

This means you will have to go through the means test and then wait for the results to see if you presumptively qualify for Chapter 7 bankruptcy. Dallas bankruptcy attorneys have seen many cases in which a debtor will potentially qualify for Chapter 7, but the judge will still require filing under Chapter 13.

If your income is higher than the median income level for Texas, you will most likely be required to file Chapter 13 instead. This is where a bankruptcy attorney from a law firm in Dallas will come into play because a lawyer can help you determine if you can fund a Chapter 13 repayment plan or if you need to argue for Chapter 7 acceptance due to your necessary expenses.

Working with a law firm in Dallas that handles bankruptcy cases like these can help you protect your rights in regards to the U.S. bankruptcy rules. It’s important to have a professional on your side to help you through the bankruptcy process so you can complete the process as easily and stress-free as possible.
